PLEASE READ THIS PRIVACY POLICY CAREFULLY BEFORE USING THE JIBJAB SERVICES. BY USING THE JIBJAB SERVICES, YOU AGREE TO THIS PRIVACY POLICY.
This Privacy Policy (“Privacy Policy”) describes how JibJab, LLC and its corporate affiliates, parents, or subsidiaries (collectively, “JibJab,” “we,” “us,” or “our”) collect, use, disclose, and protect information in connection with all websites, mobile applications, and other products and services we own, control, operate, or host, including JibJab.com, GifGab, and all related applications, services, tools, software, and functionalities (collectively, the “JibJab Services”).
This Privacy Policy is incorporated by reference into, and should be read together with, our Terms of Service (click here), Terms of Sale (click here), and Legal Notices (click here). Capitalized terms not defined here have the meaning given in our Terms of Service (click here). This Privacy Policy does not itself contain an arbitration agreement or class action waiver — those terms are set out exclusively in our Terms of Service (click here), which governs their scope and enforceability.
ACCORDINGLY, BY SUBMITTING USER MATERIALS FOR PUBLIC POSTING THROUGH ANY OF THE JIBJAB SERVICES, YOU HEREBY WAIVE ANY AND ALL PRIVACY EXPECTATIONS (INCLUDING THE PRIVACY EXPECTATIONS OF ANY OTHER INDIVIDUAL WHO APPEARS IN YOUR SUBMITTED CONTENT) WITH RESPECT TO JIBJAB’S USE OF SUCH CONTENT. IF YOU DO NOT CONSENT TO HAVE PERSONAL CONTENT VIEWABLE OR OTHERWISE ACCESSIBLE BY OTHERS, YOU SHOULD NOT SUBMIT USER MATERIALS OR ANY OTHER CONTENT TO OR THROUGH THE JIBJAB SERVICES.
JibJab is the data controller for your Personal Data (as defined below) and is based in and operates the JibJab Services from the United States. If you access the JibJab Services from outside the United States, your information will be transferred to, stored, and processed in the United States, where privacy laws may differ from those of your jurisdiction. See Section 12 (“International Users and Cross-Border Transfers”) below.
1. Information We Collect and Receive
1.1 Personal Data
We collect information you provide directly, such as your name, email address, age, and payment and billing details, to authenticate your account and provide the JibJab Services. We may also collect information directly from you or via third-party sign-on services (e.g., Facebook Connect), including personal interests, location, IP address, language, gender, education, and occupation. Your User Materials and account information may be collected and displayed to facilitate use of the JibJab Services and in our communications with you.
1.2 Usage Data
We use cookies and similar technologies to collect Usage Data, including your Collaborative Content, pages viewed, session information, key events, device type, location, language, timestamp, platform, operating system, service provider, hardware type, and browser choice, both through the JibJab Services and, via third-party technologies, across other websites and services. See Section 6 (“Cookies, Pixels, and Similar Tracking Technologies”) for detail.
1.3 Biometric Data (Facial Geometry)
When you upload User Materials containing a face, we use facial detection technology (such as Apple's on-device Vision Framework) to identify facial coordinates (e.g., the position of the mouth and jaw) in order to automate placement of your face image within Collaborative Content such as Ecards and GIFs. This detection occurs entirely on your device: the uploaded facial image and any facial coordinate or geometry data derived from it are processed locally and are not transmitted to, received, stored, or otherwise possessed by, JibJab's servers or any third party. Notwithstanding the foregoing, this process may constitute the collection of a “biometric identifier” or “biometric information” under the Illinois Biometric Information Privacy Act (“BIPA”) and similar laws.
We collect this data only with your consent, obtained at the point of upload, and only for the limited purpose described above. We do not sell, lease, trade, or otherwise profit from biometric identifiers or biometric information, under any circumstances. Because the facial detection process described above occurs solely on your device, JibJab does not receive, store, or otherwise retain facial geometry data or any other biometric identifier or biometric information on our servers or systems. The resulting data resides solely on your device and is subject to deletion in accordance with your device's own local storage and cache-clearing behavior. We will not use biometric data for any purpose beyond generating your requested Collaborative Content, including for advertising, analytics, AI/ML model training, or any monetization purpose, without separately obtaining your written consent.
1.4 Non-Personal and Aggregate Data
If Personal Data is anonymized, aggregated, or modified so that it can no longer reasonably identify you, it is “Non-Personal Data,” and we may use and disclose it for any business purpose, including the data monetization and licensing activities described in Section 3.3.
2. How We Use Your Personal Data
We use Personal Data for the purposes described below, consistent with the legal bases available to us (legitimate interest, contract performance, consent, and legal obligation, as applicable):
Account Registration and Authentication: Name, email address, age. To create and secure your account.
Communications: Name, email address. To send account, transaction, and policy-change notices, and (where you have not opted out) product announcements. Because opt-out requests may take time to propagate through our systems, you may still receive a small number of previously-scheduled announcements after opting out; we process such requests as promptly as reasonably possible.
Payment Processing: Payment and billing information. Processed through our third-party payment processor(s); see Section 3.1.
Security and Fraud Prevention: IP address, device and Usage Data. System administration, monitoring, and abuse prevention.
Service Improvement: Usage Data. Diagnosing issues, improving features, and testing.
Creating Collaborative Content: Uploaded User Materials; facial coordinate data (Section 1.3). With your consent, to generate personalized Ecards, GIFs, and similar content.
Sharing and Invitations: Your email address and those of recipients you designate. To deliver content or invitations you choose to send.
Advertising, analytics, and data licensing: Usage Data, device identifiers, demographic and interest data (excluding biometric data). See Section 3.2 and 3.3.
3. How We Share Your Information
3.1 Service Providers
We share Personal Data with third-party service providers who perform functions on our behalf — such as payment processing, order fulfillment, hosting, and data storage and security — subject to contractual limits on their use of that information. For example, we use a third-party payment and billing provider to process transactions; we do not store full payment card data ourselves.
3.2 Advertising and Marketing Partners
From time to time, JibJab and one or more partners may co-sponsor a promotion or offer a co-branded product or service (a “Joint Offering”), or JibJab may work with advertising partners to display relevant offers within the JibJab Services. The subsections below describe our current advertising partners and the categories of data involved. We name specific partners here, rather than relying only on generic “network advertiser” language, both as a matter of transparency and because several of our advertising partners' own policies require it.
3.2.1 Rokt
We have engaged Rokt Inc. (“Rokt”) to present relevant offers, promotions, and advertisements from Rokt's network of advertisers within the JibJab Services (for example, at checkout or after you complete a transaction). In connection with this partnership, we may share device identifiers, IP address, transaction- and purchase-related information, and other non-content Usage Data with Rokt so that Rokt can select and present offers that may be of interest to you. We do not share biometric data (Section 1.3) with Rokt under any circumstances.
Rokt acts as an independent party with respect to the data we share with it and processes that data under its own privacy practices, available at rokt.com/privacy-policy. We do not knowingly share data about users under the age of 16 with Rokt for advertising purposes. You may opt out of receiving personalized offers from Rokt's advertising partners at any time by visiting rokt.com/opt-out, emailing privacy@rokt.com, or using the “Your Privacy Choices” mechanism described in Section 16.8 below.
3.2.2 Other Advertising and Analytics Partners
We use Google Analytics features that support display advertising, including remarketing and demographics/interest reporting, and we may use other third-party analytics providers to collect Usage Data. We may also allow other third-party advertisers or ad networks to set their own cookies or similar technologies through the JibJab Services. These partners' use of your information is governed by their own privacy policies, not this one; we encourage you to review them. You can learn more about interest-based advertising and opt-out options generally at networkadvertising.org.
3.3 Data Licensing, Sharing, and Monetization
In addition to the sharing described above, JibJab may collect, use, analyze, license, and sell certain categories of your Personal Data and Non-Personal Data to and with third parties, including but not limited to data partners, market research firms, and artificial intelligence and machine learning developers, for purposes that may include product development, research, analytics, and training of AI/ML models. Where required by applicable law, we will present a clear, standalone disclosure and obtain your affirmative opt-in consent before enrolling you in this data sharing, and you may decline without losing access to the core JibJab Services.
Biometric identifiers and biometric information, including any facial geometry or facial coordinate data described in Section 1.3, are excluded from this Section 3.3 in their entirety. We will not license, sell, share, or otherwise monetize biometric data, with or without consent.
If we compensate you (in cash, credit, discounts, or other value) for participating in a data-sharing program, we will provide the notice required under the California Consumer Privacy Act and other applicable financial-incentive disclosure laws describing the program's material terms, the value of the data involved, and how to opt out.
3.4 Other Disclosures
We may disclose Personal Data where we believe disclosure is necessary to comply with law or legal process, protect our rights or the rights of a third party, protect the safety of the public or our users, or respond to an emergency. We may also transfer Personal Data to a successor in interest in connection with a merger, acquisition, or sale of assets; we will notify affected users of any such change as described in Section 13.
3.5 Share Function
The JibJab Services may allow you to share Collaborative Content with others through in-product share features, such as email, text message, or Facebook Share. When you use a Share Function, the recipient's contact information (such as an email address or phone number) and the shared content are transmitted to the platform or individual you designate. That transmission, and any subsequent use of the content or contact information by the recipient or the receiving platform, is governed by that platform's own privacy policy and practices, not this one.
4. Third-Party Sites and Functionalities
The JibJab Services may link to or integrate third-party sites, applications, or functionalities (such as social sign-on). Those third parties' privacy practices are governed by their own policies, not this one. We encourage you to review the privacy policy of any third-party site or service before providing it with information. If you register or sign in using a third-party sign-on service (such as Facebook Connect), you may ask us what information we received from that service by emailing help@jibjab.com, and you may request that we delete that information from our systems, subject to the same limitations described in Section 5.
5. Correcting, Updating, or Removing Your Information
You may access, update, or delete most of your Personal Data by logging into your account and using the “My Account” section, or by emailing help@jibjab.com. Complete removal of all residual data (e.g., from backups) may not always be possible.
6. Cookies, Pixels, and Similar Tracking Technologies
We and our partners use cookies, web beacons, and similar technologies to recognize your browser or device, store preferences, and deliver and measure advertising, as described in Sections 1.2 and 3.2. You can control cookies through your browser settings; note that disabling cookies may limit certain features of the JibJab Services.
We honor opt-out preference signals, including the Global Privacy Control (“GPC”), as a valid request to opt out of the sale/sharing of Personal Data for browsers or devices that send such a signal, consistent with Section 16.8.
7. Data Retention
We retain Personal Data for as long as you maintain an active account, and for an additional period thereafter as permitted or required by law (for example, to prevent fraud, comply with legal obligations, resolve disputes, or enforce our agreements). Biometric data is not retained by JibJab at all, as described in Section 1.3, and this Section 7 does not apply to that category of data. Aggregated or de-identified data may be retained indefinitely.
8. Your Privacy Rights
8.1 U.S. State Privacy Rights
If you are a California resident, or a resident of another U.S. state with a comprehensive consumer privacy law, please see our U.S. State Privacy Notice (Section 16) for a full description of the categories of Personal Data we collect and disclose, your privacy rights under applicable state law, and how to exercise them.
8.2 European Union / United Kingdom (GDPR / UK GDPR)
If you are located in the European Economic Area or United Kingdom, we process your Personal Data on the legal bases identified for each purpose in Section 2 (contract performance, consent, legitimate interest, or legal obligation, as applicable). You have the rights to access, rectify, erase, restrict or object to processing, receive a portable copy of your data, and withdraw consent at any time, by contacting us as described in Section 14. We collect your Personal Data directly from you and process it in the United States as described in Section 12. This collection does not involve a restricted transfer under GDPR Chapter V, as we have no European Economic Area– or UK-established affiliates, vendors, or processors in our data-handling chain. GDPR nonetheless applies to our processing of your Personal Data under Article 3(2), because we offer the JibJab Services to individuals in the EEA/UK and monitor their behavior.
You have the right to lodge a complaint with your local data protection authority.
8.3 Illinois Biometric Information Privacy Rights
If you are an Illinois resident, in addition to the rights above, BIPA entitles you to receive written notice before collection of your biometric identifiers or biometric information, informed written consent to that collection, and disclosure of our retention schedule and destruction guidelines, all of which are set out in Section 1.3. As stated there, we do not sell, lease, trade, or profit from biometric data under any circumstances.
9. Children's Privacy
The JibJab Services are not directed to, and are not intended for use by, children under the age of 16. We do not knowingly collect Personal Data from children under 16, and users must be at least 16 years old to register an account. If we learn we have collected Personal Data from a child under 16 without appropriate consent, we will delete it. We do not use data about known users aged 13–17 for targeted advertising or include it in the sale/sharing or data-licensing activities described in Section 3.3, except with verifiable parental or the minor's own consent as required by applicable law.
10. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Security Incident Notification
If we become aware of a breach of security compromising your Personal Data, we will notify you and take other steps required by applicable law, by email or another method reasonably calculated to reach you.
12. International Users and Cross-Border Transfers
The JibJab Services are hosted in the United States. If you access them from outside the United States, your information will be transferred to and processed in the United States as described in Section 8.2.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. If we make a material change — including expanding the third parties with whom we share Personal Data, or changing how we use previously collected Personal Data — we will provide notice by posting a prominent notice on the JibJab Services and/or emailing registered users at least thirty (30) days before the change takes effect, and, where the change involves a new sale, sharing, or use of your previously collected Personal Data, we will provide a means to opt out before that new sharing begins with respect to your existing data. Your continued use of the JibJab Services after a change takes effect constitutes acceptance of the updated Privacy Policy.

15. Governing Law
This Privacy Policy is governed by the internal laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable law requires otherwise (for example, mandatory consumer-protection or biometric-privacy provisions of your home jurisdiction).
16. U.S. State Privacy Notice
This Section 16 is our U.S. State Privacy Notice and supplements the JibJab Privacy Policy and describes the rights available to residents of certain U.S. states under applicable state privacy laws, and how to exercise them. Capitalized terms not defined here have the meaning given in the Privacy Policy.
16.1 Who This Notice Covers
This Notice applies to residents of California, and to residents of other U.S. states with comprehensive consumer privacy laws in effect, to the extent those laws apply to JibJab's processing of their Personal Data. See Section 16.9 for the current list of covered states.

16.3 Sensitive Personal Information
We collect one category of Sensitive Personal Information as defined under CPRA and similar state laws: biometric information, specifically facial geometry data used solely to automate placement of your photo within Collaborative Content (Privacy Policy Section 1.3). We do not use or disclose this data for any purpose other than that limited function, and we never sell, share, or license it. We do not collect other categories of Sensitive Personal Information (such as precise geolocation, government ID numbers, racial or ethnic origin, religious beliefs, health information, or genetic data).

16.7 How to Exercise Your Rights
You may submit a request by emailing help@jibjab.com or by using the “Your Privacy Choices” link on the JibJab Services. We will verify your request using information associated with your account (e.g., matching the email address on file) before processing it. You may designate an authorized agent to submit a request on your behalf; we may require proof of the agent's authority and separate verification of your identity.
We will respond within 45 days of receipt, with a one-time 45-day extension where reasonably necessary (or the timeframe required under your state's law, if different). If we deny your request, you may appeal by replying to our denial email; we will respond to appeals within 60 days (or the timeframe required under your state's law).
16.8 Opt-Out Mechanisms, Global Privacy Control, and Financial Incentives
You can opt out of the sale/sharing described in Section 16.4.2, and of targeted advertising, at any time by using the “Your Privacy Choices” link on the JibJab Services, or by emailing help@jibjab.com. We honor the Global Privacy Control (GPC) signal as a valid opt-out request for browsers and devices that send it, consistent with Privacy Policy Section 6.
We do not currently offer any financial incentive, discount, or other value in exchange for Personal Data. If we introduce such a program, we will provide a separate notice describing its material terms, the value of the data involved, and how to opt out, before you are enrolled, consistent with Privacy Policy Section 3.3.
16.9 States Covered by This Notice
This Notice is provided pursuant to the following (as may be amended from time to time): the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA); and the comprehensive consumer privacy laws of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Florida, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island. Residents of states not listed here may still contact us using Section 16.7, and we will consider the request under our general Privacy Policy.
16.10 Minors
See Privacy Policy Section 9. We do not use data about known users aged 13–17 for targeted advertising, sale, or sharing, except with consent as required by applicable law.
